As sociedades contemporâneas se encontram diante de uma dupla relação entre o poder judiciário e a política: no âmbito normativo a imparcialidade figura como um pressuposto; no âmbito descritivo a imparcialidade não se configura. Este artigo analisa este descompasso entre os âmbitos normativo e descritivo da relação entre poder judiciário e política em três momentos: primeiramente, apresenta-se a distinção entre julgamentos políticos e julgamentos judiciais elaborada por Nadia Urbinati; em segundo lugar, a partir da obra de Jeremy Waldron, questiona-se (...) a tese da imparcialidade judicial e apresenta-se a defesa feita pelo autor de um modelo de revisão judicial em sentido fraco; em terceiro lugar, também a partir da obra de Waldron, mostra-se como a atuação política do judiciário afeta o ideal de Estado de Direito. Cristina Lafont gives an impressive defence of deliberative democracy against its critics. This article considers in detail her engagement with the ‘deep pluralist’ position that characterizes Nadia Urbinati’s, Jeremy Waldron’s and Richard Bellamy’s positions. After considering Lafont’s threefold argument against the deep pluralists, I contend that she vacillates between a substantialist and recursive-iterative defence of the democratic ideal. Her defence of judicial review does not consider some of the strategic ways in which civil society groups may approach the (...) process. I conclude by arguing that constitutionalization is not always a salutary move for resolving controversial issues in a democracy. (shrink)

The public debate on climate change is filled with moral claims. However, scientific knowledge about the role that morality, ethics, and values play in this issue is still scarce. Starting from this research gap, we focus on corporations as central decision makers in modern society and analyze how they respond to societal demands to take responsibility for climate change. While relevant literature on business ethics and climate change either places a high premium on morality or presents a strong skeptical bias, (...) our sociological model depicts morality as an indeterminate force: it can lead to both workable solutions or merely reinforce the status quo, depending on what different corporations make of it. We describe, on the one side, the diffusion of moral values in the media discourse on climate change and, on the other side, the specific responses of corporations. While the media discourse generates a pressure on corporations to act responsibly, their moral claims do not provide clear advice for action. As a result, morality becomes available to organizations as a medium that can be re-specified according to their internal dynamics. Corporations transform moral values into something compatible with their own structures through a variety of different responses: introducing formal ethical structures (e.g., codes of conduct), initiating value-oriented projects, or developing informal moral norms, and so on. In some occurrences, morality becomes a mere façade, while in others it serves as a decision-making criterion and deeply influences core activities in firms. (shrink)

Often, when several norms are present and may be in conflict, individuals will display a self-serving bias, privileging the norm that best serves their interests. Xiao and Bicchieri (J Econ Psychol 31(3):456–470, 2010) tested the effects of inequality on reciprocating behavior in trust games and showed that—when inequality increases—reciprocity loses its appeal. They hypothesized that self-serving biases in choosing to privilege a particular social norm occur when the choice of that norm is publicly justifiable as reasonable, even if not optimal (...) for one of the parties. In line with the literature on motivated reasoning, this justification should find some degree of support among third parties. The results of our experimental survey of third parties support the hypothesis that biases are not always unilateral selfish assessments. Instead, they occur when the choice to favor a particular norm is supported by a shared sense that it is a reasonable and justifiable choice. (shrink)

The illicit diffusion of intimate photographs or videos intended for private use is a troubling phenomenon known as the diffusion of Non-Consensual Intimate Images (NCII). Recently, it has been feared that the spread of deepfake technology, which allows users to fabricate fake intimate images or videos that are indistinguishable from genuine ones, may dramatically extend the scope of NCII. In the present essay, we counter this pessimistic view, arguing for qualified optimism instead. We hypothesize that the growing diffusion of deepfakes (...) will end up disrupting the status that makes our visual experience of photographic images and videos epistemically and affectively special; and that once divested of this status, NCII will lose much of their allure in the eye of the perpetrators, probably resulting in diminished diffusion. We conclude by offering some caveats and drawing some implications to better understand, and ultimately better counter, this phenomenon. (shrink)

Background The global COVID-19 pandemic has challenged nurse leaders in ways that one could not imagine. Along with ongoing priorities of providing high quality, cost-effective and safe care, nurse leaders are also committed to promote an ethical climate that support nurses’ moral courage for sustaining excellence in patient and family care. Aim This study is directed to develop a structure equation model of crisis, ethical leadership and nurses’ moral courage: mediating effect of ethical climate during COVID-19. Ethical consideration Approval was (...) obtained from Ethics Committee at Faculty of Nursing, Alexandria University, Egypt. Methods A cross-sectional design was used to conduct this study using validated scales to measure the study variables. It was conducted in all units of two isolated hospitals in Damanhur, Egypt. A convenient sample of 235 nurses was recruited to be involved in this study. Results This study revealed that nurses perceived a moderate mean percent (55.49 ± 3.46) of overall crisis leadership, high mean percent (74.69 ± 6.15) of overall ethical leadership, high mean percent (72.09 ± 7.73) of their moral courage, and moderate mean percent of overall ethical climate (65.67 ± 12.04). Additionally, this study declared a strong positive statistical significant correlation between all study variables and indicated that the independent variable (crisis and ethical leadership) can predict a 0.96, 0.6, respectively, increasing in the dependent variable (nurses’ moral courage) through the mediating impact of ethical climate. Conclusion Nursing administrators should be conscious of the importance of crisis, ethical leadership competencies and the role of ethical climate to enhance nurses’ moral courage especially during pandemic. Therefore, these findings have significant contributions that support healthcare organizations to develop strategies that provide a supportive ethical climate. Develop ethical and crisis leadership competencies in order to improve nurses' moral courage by holding meetings, workshops, and allowing open dialogue with nurses to assess their moral courage. In the present manuscript, we comment upon a paper that strongly criticized an expert report written by the consultants of the defense in a case of pedophilia, in which clinical and neuro-scientific data were used to establish the causal link between brain alterations and onset of criminal behavior. These critiques appear to be based mainly on wrong pieces of information and on a misinterpretation of the logical reasoning adopted by defense consultants. Here we provide a point-by-point reply to the issues (...) raised in the above paper and also discuss the potential role that neuroscience may contribute in the forensic context. Did the forensic neuroscience defense consultants claim the existence of a deterministic relationship between brain structure or function and behavior? How did the neuroscientific logic work in this specific case? How may the classic psychiatric/neurologic examination and neuroscientific evidence work side by side? Does the rarity of a disease impact on the causal relationship between the disease and the crime? Do neuroscientific data need to be interpreted? We address the above questions and conclude that neuroscience may strengthen the results of psychiatric evaluations, thus reducing uncertainty in the forensic settings. (shrink)

A two non-linear dynamic models, first one in two state variables and one control and the second one with three state variables and one control, are presented for the purpose of finding the optimal combination of exploitation, capital investment and price variation in the commercial fishing industry. This optimal combination is determined in terms of management policies. Exploitation, capital and price variation are controlled through the utilization rate of available capital. Health care is ubiquitous in the industrialized world. Yet, every medical development, technique, and procedure impacts the environment. Green bioethics synthesizes environmental ethics and biomedical ethics, thus creating an interdisciplinary approach to sustainable health care. Notably, green bioethics addresses not the structure of environmental sustainability in health-care institutions but the sustainability of individual health-care offerings. It parallels traditional biomedical ethics by providing four principles for ethical guidance: distributive justice, resource conservation, simplicity, and ethical economics. Through these four principles, green bioethics (...) presents a coherent framework for evaluating the sustainability of medical developments, techniques, and procedures. The future of our world may very well depend on how effectively we halt ecological destruction and conserve our resources in all areas of life. The principles of green bioethics, outlined in this book, will advance sustainability in health care. (shrink)

We present five studies investigating the effects of approach and avoidance behaviours when individuals do not enact them but, instead, learn that others have performed them. In Experiment 1, when participants read that a fictitious character (model) had approached a previously unknown product, they ascribed to this model a liking for the object. In contrast, they ascribed to the model a disliking for the avoided product. In Experiment 2, this result emerged, with a smaller effect size, even when it was (...) clear that the behaviours followed specific instructions from a third party. The model had been a mere executor instead of behaving autonomously. Finally, in Experiments 3, 4, and 5, we showed, with direct and indirect measures of attitudes, that reading that the model had approached vs avoided products was sufficient to create preferences in the participant for the approached one, regardless of whether it was explained that the model was a mere executor. This research highlights the largely unexplored effects of vicarious approach/avoidance behaviours. Theoretical and practical implications and possible developments of this line of research are discussed. (shrink)

Perhaps because groupishness comes so easily to humans, clear operational definitions of the phenomena and justifications for the claim that it is deep‐seated are lacking in much of the literature. Furthermore, the assertion of human groupishness glosses over several important questions including which behaviors, which social boundaries, and which evolutionary processes make us groupish. In this paper I use an evolutionary lens, and cross‐species and cross‐cultural comparative examples to clarify the bases on which such a claim of particular human groupishness (...) can be made. Specifically, if humans are particularly groupish, it is because we produce culturally‐structured social landscapes. This means the cognitive science of groupishness must incorporate the social science of the cultural evolution of group boundaries. (shrink)

Na ausência de uma teoria explícita da justiça, em Arendt, iremos abordar o assunto através de um desvio: tomaremos os campos de concentração como ponto de partida; abordaremos os conceitos de mal radical e banalidade do mal; e mostraremos que, nessa autora, o antídoto para a injustiça reside na concepção de justiça significando julgamento e não ao modo pensado pela tradição: virtude e valor. Essa discussão se dá dentro da tentativa arendtiana de recuperar o sentido originário da política, o mundo (...) comum, esteio da condição humana na qual a diversidade e a pluralidade são requisitos para novos começos, novas instituições, novos atos de liberdade. Utilizaremos, prioritariamente, para balizar a nossa reflexão, além da obra de Hannah Arendt, os livros Justiça em tempos sombrios, de Cristina Ribas e Hannah Arendt e a banalidade do mal, de Nádia Souki. High‐throughput DNA analyses are increasingly being used to detect rare mutations in moderately sized genomes. These methods have yielded genome mutation rates that are markedly higher than those obtained using pre‐genomic strategies. Recent work in a variety of organisms has shown that mutation rate is strongly affected by sequence context and genome position. These observations suggest that high‐throughput DNA analyses will ultimately allow researchers to identify trans‐acting factors and cis sequences that underlie mutation rate variation. The COVID-19 pandemic has raised challenges in dealing with information sharing by the public and the authorities. There are two categories of information sharing on social media that are believed to be potentially problematic and unethical: the sharing of personal information of patients and the sharing of fake news or false information. We present a discussion on how the response to the COVID-19 pandemic in Malaysia can be ethically handled in terms of information sharing. It is recommended that the public (...) should cultivate the basic skills to evaluate information and determine its validity. On the other hand, the authorities should refrain from placing the blame on patients to avoid them from being stigmatized. It is crucial that all parties are aware of their ethical duty to ensure only ethical and valid information gets shared on social media. (shrink)

In this paper, we undertake a genealogical study to illustrate how Karl Marx derives his concept of class conflict from Adam Smith’s theory of social order. Based on these findings, we argue that both Smith’s and Marx’s political economies should be interpreted in relation to each other – from the perspective of social philosophy, in particular their shared concepts of social order and necessary opposition of class interests. By appeal to process philosophy, we also argue that this reinterpretation needs to (...) take into account two other ideas shared by Smith and Marx, namely the social individual as person-in-community, and the pursuit of desirable social forms from a humanistic perspective. We conclude by contending that business management practice would benefit from understanding the role of class tensions and social order in stakeholder relations. Specifically, management and organization scholarship should focus on philosophical examinations of the influence of social order on economic activities in an organization in a way that is far more appreciative of the social relations of individuals as being the primary, rather than a secondary, concern. This paper asks how to account for vulnerable integrity in the temporal dynamism of human lives without relying on a subtractive vision of integral human nature, borrowing from presumed past or future rationality and maturity, or depending on an external attribution of dignity. Illustrating the challenges with vignettes from the author’s life, it argues inductively that human integrity includes morally inviolable vulnerability to others with whom we are in interdependent relationship and without whom we cannot develop or maintain our selves. (...) Others reside at the core of our integrity, for better and for worse, and we reside at theirs. Augustine’s accounts of memory, time, and the narrative self; Whiteheadian process thought’s understanding of continuity through change; and feminist theories of narrative all provide theological and philosophical justifications for this vision of integrity. John Wall’s and Johan Brännmark’s non-foundational approaches to integrity and human rights lead us to the same conclusion without entailing theological anthropological claims, ensuring its relevance in a pluralist culture. Evolutionary developmental biology (evo-devo) is often vindicated by theoreticians of the field as a mechanistic science that brings a mechanistic perspective into evolutionary biology. Usually, it is also portrayed as stressing the causal role that development plays in the evolutionary process. However, mechanistic studies in evo-devo typically refer to lineage-specific transformations and lack the generality that evolutionary explanations usually aim for. After reviewing the prospects and limits of a mechanistic view of evo-devo and their studies of homology and novelty, in (...) this chapter I propose a way to combine the mechanistic view of evo-devo with the population-level inclination of more classical approaches to evolution. Such a proposal provides a philosophical framework for understanding the causal role of development in evolution both as mechanistic and as generalizable, population-level. (shrink)

The focus of this research is the re-use of the Yakṣī image. The study of the evolution of a certain iconography induces one to face the problem of re-use in correlation to the transmission of images in time, and of their survival or transformation in historical and cultural environments different from the original ones. In fact, every different time period formulates its new iconography but above all it takes up again pre-existing images: these may be “revived” and, hence, may be (...) rediscovered after an oblivion, or they may have “survived” either maintaining their original aspect or having suffered modifications. In the figurative domain re-use is often used as an explicit quotation in order to assert a new ideology, a new ruler, or a new religion. In this article we investigate the different aspects of the mechanism of re-use of the iconography of Yakṣī focusing, in the end, on the case-study of Cenna Keśava Temple at Beḷūr. (shrink)

DIREITO E HISTÓRIA NA FRANÇA PÓS-REVOLUCIONÁRIA: CONSIDERAÇÕES A RESPEITO DA CONTRIBUIÇÃO DE EMMANUEL SIEYÈS PARA O CONSTITUCIONALISMO MODERNO.

During the Nineties Italian politics underwent major changes. Following the uncovering of systemic corruption, the current political establishment was wiped out. The system of representation at both the national and local level underwent a significant transformation that improved voters’ control over their elected representatives. We argue that both events were the consequence of citizens’ demand for greater accountability of public officers. We model the relationship between voters and politicians as a repeated Trust game. In such game, cooperation can be attained (...) by means of external or internal controls. Whereas judicial investigation is an external monitoring mechanism, the electoral reform provides controls internal to the political system. We explain the Italian transition between these different modes of control and show under which conditions a cooperative equilibrium can be established in which voters trust their representatives who in turn act in the public interest.
